The Appellate Court of Illinois, First District, ruled in Beermann’s favor on an issue of first impression in Illinois, allowing the firm to proceed on its claim against an individual partner for the unsatisfied judgment of his partnership. The court found that three cases from sister jurisdictions, which were cited in Beermann’s brief, were instructive on the issue. Its holding reinforces the statutory scheme in Illinois which allows a party who has obtained a judgment against a partnership to file a separate lawsuit against its partners for the unsatisfied portion of that judgment.
